Why Banking Requirements Are Not Universal

LLC formation, EIN application, and banking are separate processes. Wyoming controls the state filing, the IRS controls the EIN process, and each financial provider applies its own KYC, address, industry, and risk rules.

Valid Passport or Government-Issued ID
For an international founder, a valid passport is usually the safest primary identity document. Some providers accept other government-issued identification. It should be current, readable, unaltered, and consistent with the application.
A passport is not normally filed with Wyoming or attached to Form SS-4. It is mainly used for identity verification by a setup service, bank, fintech, or payment provider. Multi-member companies may need IDs for additional owners or controllers.
Proof of Residential Address
This document connects the founder to the home address entered during KYC. Accepted evidence may include a recent utility bill, bank statement, government letter, or another official record. The details should match the application.
Do not confuse a residential address with the LLC’s registered office or operating address. A Registered Agent address serves a statutory purpose. State-Filed LLC Formation Document
For a Wyoming LLC, the core formation filing is the Articles of Organization. Once accepted, the filed document establishes that the LLC was formed with the state. Keep the filed copy and any state confirmation in permanent company records.
The legal company name on later documents should match this record. The IRS advises legal entities to register with the state before requesting an EIN. Banks and fintechs commonly use the state-filed document to verify the entity’s name, jurisdiction, and existence. Operating Agreement
The Operating Agreement is the LLC’s internal governance document. It can record ownership, management, distributions, and signing powers. Even for a single-member LLC, it helps demonstrate control.
Wyoming does not require the Operating Agreement to be filed with the Secretary of State. That does not make it unimportant. A bank or fintech may request it as ownership or authority evidence, while another provider may not.

IRS Form SS-4
Form SS-4 is the application for an Employer Identification Number; it is not the confirmation that an EIN has been assigned. It records details such as the LLC’s legal name, addresses, responsible party, entity type, reason for applying, start date, and business activity.
Names and addresses should be consistent with the formation record and the intended company file. Keep a copy of the submitted form. For a foreign responsible party who does not have and is ineligible to obtain an SSN or ITIN, the current IRS Instructions for Form SS-4 say to enter “foreign” or “N/A” on line 7b. An ITIN is therefore not automatically required to form the LLC or obtain its EIN.
EIN Confirmation Letter

After assignment, the IRS confirmation—not the blank SS-4—serves as the strongest EIN evidence. This is commonly the original CP 575 notice. If that original is unavailable, the IRS provides confirmation routes that can include an eligible digital CP 575, an entity transcript, or Letter 147C, EIN Previously Assigned.
Keep the confirmation permanently and use the legal name and EIN exactly as shown. If the letter is missing, do not rush into a second EIN application. Proof of Business Activity
This is not one universal form. It is a practical evidence category that helps a reviewer understand what the company does, where money comes from, and how the account will be used.
Depending on the provider and the company’s stage, useful evidence may include client contracts, signed service agreements, invoices, a working website or storefront, customer information, a clear business description, and realistic expected payment volumes. Source-of-funds questions may trigger requests for bank statements or additional records.
Pre-revenue founders should be transparent. Provide a coherent business description, planned markets, expected counterparties, and projected payment flows; never fabricate contracts, invoices, customers, or activity.
How to Organize Your LLC Document Folder

Create four folders: Founder ID and Address, State Formation, IRS and EIN, and Banking and Business Activity. Use clear names, retain complete pages, and separate originals from upload copies.
Before applying, compare the legal name, addresses, ownership percentages, responsible party, and business description across every document. Correct genuine errors through the appropriate issuer or filing process; do not edit official documents yourself.
What Banks and Fintechs May Request in Addition
Additional requests can include Initial Resolutions or Organizational Consent, an ownership chart, operating-address proof, licenses, customer or supplier details, source-of-funds records, transaction corridors, certified copies, or translations.
For example, Mercury currently lists formation documents, an IRS-issued EIN document, and identification among its core application materials, while also asking about the physical operating address, source of funds, and US operations.
